By downloading, accessing, or using the App, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the App.


1Who can use the App (age requirements)

The App is intended for users aged 13 or older.

If you are under 18, you may use the App only if your parent or legal guardian has reviewed and agreed to these Terms on your behalf and is responsible for your use of the App.

You represent that you meet the age requirements above and that all information you provide is accurate.

Note: Platform rules and Apple account requirements vary by country/region; you must still comply with these Terms regardless of platform eligibility.


2The App and what it does

Walldrop is an iOS application that lets you:

  • upload and store images,
  • organize images into "spaces" that can be shared by invitation, and
  • apply AI-based edits using predefined styles (you cannot enter free-form prompts).

The App is currently offered free of charge and does not include subscriptions or in-app payments.


3Accounts

You may need to create an account to use certain features.

You are responsible for:

  • maintaining the confidentiality of your account credentials,
  • all activity under your account, and
  • promptly notifying us if you suspect unauthorized access.

We may refuse registration, suspend, or terminate accounts as described in Section 11.


4User content and sharing

4.1 Your content

"User Content" means any images or other content you upload, generate, or store through the App (including AI-edited outputs based on your uploads).

Private by default: Content is private unless you share it via a space and invite others.

4.2 Spaces, invitations, and downloads

If you invite others to a space, you understand:

  • invited users may be able to view, download, export, and share content available in that space (as permitted by the App's features), and
  • you are responsible for sharing only content you have rights to share.

5Your rights and our limited license to operate the App

You keep your rights in your User Content, subject to applicable law.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, transmit, display, and otherwise use your User Content only as necessary to:

  • operate, maintain, secure, and provide the App,
  • perform AI processing you request through the App's features,
  • troubleshoot, prevent abuse, and enforce these Terms.

This license ends when your content is deleted from our systems, except where retention is required by law or for legitimate security/back-up purposes for a limited time (see Section 12).


6AI features and third-party processing

The App uses third-party AI providers (currently including OpenAI and Google (Gemini)) to perform AI edits via predefined styles.

When you use AI editing features, your relevant inputs (e.g., the image you submit for editing) may be processed by these providers to produce the output. Your use is also subject to our Privacy Policy and (where applicable) the providers' terms.

No guarantee of results: AI outputs can be unpredictable and may contain errors or undesired results. You are responsible for reviewing outputs before using or sharing them.


7Acceptable use and prohibited content

You may not use the App to upload, generate, share, store, or distribute any content that:

  • Breaks the law or promotes illegal activities.
  • Is sexual content involving minors or exploits minors in any way (zero tolerance).
  • Is hateful, harassing, threatening, or incites violence.
  • Infringes intellectual property rights (including copyrighted images you do not have rights to use).
  • Violates privacy or data protection rights (e.g., doxxing, sharing someone's personal data without permission).
  • Contains malware, attempts to gain unauthorized access, or disrupts the App or infrastructure.
  • Is fraudulent, deceptive, or impersonates others.
  • Attempts to bypass restrictions, scrape the service, or reverse engineer the App except to the extent permitted by law.

We may remove content and take enforcement actions at our discretion (see Section 11).


8Reporting content

The App may provide a way to report content or behavior. If you report something, please provide enough detail to evaluate the report.

We may remove content or restrict access if we believe it violates these Terms or may create risk or harm.


9Intellectual property in the App

The App, including its software, design, trademarks, and underlying content (excluding User Content), is owned by the Provider or licensors and is protected by applicable laws.

We grant you a limited, personal, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms.


10Third-party services and infrastructure

The App relies on third-party infrastructure and services (including Cloudflare for hosting/storage and AI providers for AI editing). We are not responsible for outages or failures caused by third parties, though we will try to restore service as reasonably possible.


11Suspension and termination

We may suspend or terminate your account, or restrict access to features, if we believe you:

  • violated these Terms,
  • created risk or potential harm,
  • attempted abuse, fraud, or security attacks, or
  • used the App in a way that could expose us or others to liability.

Inactive accounts

We may terminate accounts that have been inactive for more than 1 year. Where reasonable, we may provide notice before doing so.


12Deletion and retention

If you delete your account, we will delete your personal data and content within 90 days, unless:

  • retention is required by law, or
  • we need limited retention for security, fraud prevention, backups, or dispute handling.

13Disclaimers

To the maximum extent permitted by law:

  • The App is provided "as is" and "as available."
  • We do not guarantee uninterrupted availability, error-free operation, or that AI outputs will meet your expectations.
  • You are responsible for your use of the App and any decisions made based on content or AI outputs.

14Limitation of liability

To the maximum extent permitted by law, the Provider will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business interruption.

Liability cap

Where liability is permitted but limited, the Provider's total liability arising out of or related to the App will not exceed the greater of:

  • the amounts you paid to the Provider for the App in the six (6) months before the event giving rise to the claim, or
  • EUR 50.

Important legal carve-outs

Nothing in these Terms limits or excludes liability for:

  • intent (Vorsatz),
  • gross negligence (grobe Fahrlässigkeit),
  • liability for injury to life, body, or health,
  • mandatory statutory liability that cannot be excluded (including certain product liability),
  • or other rights that cannot be waived under applicable consumer laws.

15Changes to the App and the Terms

We may change the App and these Terms from time to time.

If we make material changes to the Terms, we will provide reasonable notice (e.g., in-App notice or on our website). Your continued use after the effective date of the updated Terms constitutes acceptance.


16Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer and mandatory consumer protection laws in your country of residence grant you additional rights, those rights remain unaffected.

Jurisdiction

  • If you are a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, exclusive place of jurisdiction is Passau, Germany.
  • Otherwise, the statutory rules on jurisdiction apply.

17Apple-specific terms (iOS)

These Terms are between you and the Provider, not Apple. Apple is not responsible for the App or its content.

You acknowledge that Apple and Apple's subsidiaries may be third-party beneficiaries of these Terms and may have the right to enforce them against you.
